Terms & conditions

Article 1: General

1.1 Renzy – Twizy driver(s) require(s) a minimum age of 21 years and must have held a category B driver’s licence for a minimum of 3 years.

1.2 The tour participant / rental customer has received the Renzy – Twizy in good working order from Renzy. The tour participant / rental customer must make any comments / observations known to Renzy before entering into the tour or rental period.

1.3 In the event where the Renzy – Twizy is returned past the prior agreed upon time, Renzy will be entitled to charge additional time. Renzy has the right to deduct said time from the deposit paid by the tour participant / rental customer.

1.4 Any deviation from the pre-programmed GPS route with the Renzy – Twizy is prohibited.

Article 2: Reservations / Obligations

2.1 Anyone who enters the agreement on behalf of a group will be held jointly and severally liable for all obligations deriving from said agreement.

2.2 By making a reservation, the tour participant / rental customer commits to full payment of the reservation fee.

2.3 The reservation will be invoiced within 8 days after which payment must be fulfilled within 8 days past the invoice date. Payment to be received by Renzy will be no later than before the start of the tour / rental period of the Renzy – Twizy, also when the start of the tour / rental period falls within the payment period of 8 days.

2.4 In the event of non-compliance with the previous article, Renzy is entitled to cancel the agreement between both parties without any liability and with a continued obligation for the rental customer to comply with any payment obligations in accordance with the signed agreement between both parties.

Article 3: Cancellations

3.1 Cancellations must be sent in writing (email or WhatsApp) with date and reason to hello@renzy.nl or 06 523 730 71.

3.2 The reservation payment will be reimbursed in full in the event of cancellation at least 14 days prior to the start of the tour.

3.3 The reservation payment will be reimbursed up to 50 % in the event of cancellation between 10 – 14 days prior to the start of the tour.

3.4 The reservation payment will be charged in full in the event of cancellation within 10 days prior to the start of the tour or in the event of a no show at the start of tour.

3.5 A reduction of the number of Twizies larger than 1 and within a range of 25% is possible but no later than at least 14 days prior to the start of the tour. The cancellation terms 3.1 through 3.4 will be applied to a reduction of the number of Twizies larger than 25%.

Article 4: Rescheduling / Change of tour date

4.1. Rescheduling and / or changing the date of the tour is possible, but no later than 14 days prior to the start of the tour and this must be sent in writing (email or Whatsapp) with date and reason to hello@renzy.nl.

4.2 Rescheduling and / or changing the date of the tour within 14 days before the start of the tour is not possible. In this event the cancellation terms 3.1 through 3.4 will apply.

Article 5: Bad weather or weather forecast

5.1 Bad weather or a bad weather forecast are never a valid reason for cancellation of your tour.

5.2 Weather forecasts on weather websites and in applications can change hourly. Extreme weather forecasts will be evaluated by Renzy on the day of the tour.

5.3 In the event of a special weather forecast issued by the competent authorities consisting of code yellow or higher, or in the event where Renzy acknowledges the weather conditions to be unfavourable for driving the tour, the reservation payment will be reimbursed in full or converted into a voucher after consultation with the tour participant / rental customer.

5.4 Should you yourself decide to cancel because of the predicted weather forecast, the cancellation terms 3.1 through 3.4 will apply.

Article 6: Vehicle unavailability / Technical failure

6.1. In the event of rescheduling, changing and / or cancellation of the tour date by Renzy due to vehicle unavailability or a technical failure of the Renzy – Twizy that is unfavourable for driving the tour, the reservation fee will be fully reimbursed or converted into a voucher after consultation with the tour participant / rental customer.

6.2. In the event where a technical failure occurs with the Renzy – Twizy during the GPS tour after which the tour cannot be completed, the tour participant / rental customer will receive a voucher to drive the GPS tour at another date.

Article 7: Deposit / Liability

7.1 The tour participant / rental customer must pay a deposit of €150,- for every rented Renzy Twizy to be received by Renzy prior to the start of the tour / rental period. In the absence of the deposit paid to Renzy, Renzy has the right to cancel the agreement while the tour participant / rental customer will still be obligated to pay the reservation fee as stipulated in article 2.

7.2 All Renault Twizies owned by Renzy have Fully Comprehensive insurance. All damages caused by the tour participant / rental customer is covered. There is however an excess; the tour participant / rental customer must pay an excess amount of €500,- for every insurance claim when having caused any damages. All Renzy – Twizies also have passenger coverage. Insurance papers can be seen upon request at the pick-up location.

7.3 The tour participant / rental customer must report any and all damages of any nature or any facts and / or circumstances related to any damages to Renzy as fast as possible and must comply with any instructions given by Renzy to retain the Renzy – Twizy and for the preservation of Renzy’s rights. Non-compliance with this stipulation will result in the tour participant / rental customer becoming fully liable for all damages and costs. Renzy is entitled to recover any damages caused by the tour participant / rental customer to the rental property through deduction of the deposit. The tour participant / rental customer will be charged for any (uninsured) damages that amount to a total higher than the total amount of the deposit.

7.4 In case of loss or theft, the full purchase amount of the Renzy – Twizy must be paid to Renzy. The purchase amount will be determined by the current retail price at that moment.

7.5 Renzy cannot be held liable for any damages incurred by the rental customer or any third parties. The tour participant / rental customer is and will therefore remain fully liable for any damages and / or injuries incurred by third parties during the entire duration of the rental period.

7.6 The tour participant / rental customer will use the Renzy – Twizy for their own account and risk and indemnifies Renzy for any and all claims made by third parties for damages caused by the tour participant / rental customer i.e. any damages caused with the Renzy – Twizy. Damages also include consequential damages.

Article 8: Rules of conduct during use

8.1 Every driver of the Renzy – Twizy must undergo a short driving skill training / instruction. This will be carried out by a Renzy employee. The tour participant / rental customer must comply with the traffic rules and local regulations during the course of the tour. Any traffic, speeding and parking fine(s) will be borne by the tour participant / rental customer.

8.2 At all times, Renzy will have the right to confiscate the Renzy – Twizy made available during the tour / rental period in the event of abuse or intoxication (meaning a higher blood alcohol level than legally permitted) without reimbursement of the rent / reservation payment.

8.3 The tour participant / rental customer will handle the Renzy – Twizy and any accessories with care and will use the Renzy – Twizy as a cautious and sensible person and in accordance with the intended purpose.

Article 9: Payment

9.1 The payment deadlines applied by Renzy must be considered as definite deadlines.

9.2 In case of late payment, the rental customer will consequently be in default by law. In this instance, Renzy is entitled to charge the rental customer a legal interest on the invoice amount. All judicial and extrajudicial collection fees (with a minimum of €250,00) that have occurred as a result of non-compliance by the rental customer concerning any payment obligations towards Renzy will be charged to the tour participant / rental customer.

9.3 The courthouse situated in the place of establishment where Renzy is registered has exclusive competency to take note of any disputes unless the district judge is considered competent.

Article 10: Publication reference and change of terms and conditions

10.1 These terms and conditions have been filed at the Chamber of Commerce in Amsterdam, filed under registration number 76989410.

10.2 The most recently filed version or the applied version at the time of entering into the agreement with Renzy will apply.
